Kottakuppam, a district under corruption

2- News.

A French citizen living in our village told me a new story and some precisions concerning another case already evoked in a letter.

The Russian young lady was obliged to leave the place she rent to V. Mani only after several months, but she paid five years renting 300.000 rupees. Evidently these thieves have returned no one rupee !

Herfather is also a well-known physicist in Russia and her mother professor of medicine, through the intermediary of the embassy from Russia to Delhi they lodged complaint.

One night, the villain S. Sudhakar and Charlie, a Belgium citizen renting a house belonging to S. Sudhakar, were driving under the ascendancy of the alcohol, they were arested by police. S. Sudhakar phoned the "poriki" V.Mani, immediatly they were free. Again a supplementary proof that the police protects the villain V. Mani.

3- Send letter.

This morning, I send by registered post all my complaints to Superintendant of police in Villupuram.

1 - In July 2000, we buy to the panchayat of Thantirayankuppam, a village situated in the district of Kottakuppam (Tamil Nadu), a small land with a house in ruin.

He gave us a document that has no legal value, but we evidently ignored it. We ask if all is in order, they answer us that yes with the smile. This land had been proposed me by one of my students of the French Alliance, S. Sudhakar that lived in this village.

2 - Some times later, we received the visit of the Talaivar of Kottakuppam, M. Chanmugan, he proposed us to help to have electricity. We gave him 25.000 rupees because we asked for 3 phases and it was necessary to install a supplementary post.

3 - One week later we had the current. What we ignored, it is that the Taluk officer had come with him or his son to measure our land in our absence. Finally, we didn't have access to the land-registry book where face our land and we could not know that there was a problem with the pata or that it didn't exist. So we have the absolute proof of the connivance between the villains of this village that sold us this land, in fact V.Mani their chief, and M. Chanmugan that deceived us knowingly. V. Mani is an activist of the same political party that Chanmugan, it explains it

4 - In 2004, following multiple problems with these villains, we decided to register our land officially in Vanur Taluk office. There, we presented the document of the panchayat and the one of the Taluk office of Kottakuppam, not of problem. The domcument of the panchayat having been established in favor of my wife, it is her that sold it to me considering her bad state of health. We were accompanied by S.Sudhakar that knew the State document writer R.Sachitanandam and S.Sudhakar served witness in a certain manner.

5 - In 2006, my wife underwent in France a very big cardiac operation, the pose of two valves inside the heart, otherwise he had only 6 months to live according to the physicians.

6 - In 2009, the state of health of my wife staying troubling, we decided to sell our land as quickly as possible, because she cannot live anymore in India and doesn't support the heat anymore since her operation.

7 - Two different people present themselves by chance to buy our land. We agreed about the price, the sale can immediately take place, but problem, they ask us for the pata that we didn't have.

8 - I spoke of it with S. Sudhakar, and new problems there are going to occur.

9 - I went to the Taluk office of Kottakuppam. The first time the civil servant told to me that he would provide me the pata under 10 or 15 days, and the following time the pata didn't exist anymore.

It is necessary to say that an employee who works in this office and that lives in our village, had heard our conversation, he had to in to speak with V. Mani that made pressure then on the chief of this office, it is also called of civil servant's corruption.

10 - Just before we had gone to meet the Dasildar in Vanur, I had explained him our problem, he had indicated me the way to follow to get the pata, I had passed therefore by different offices, I had filled some papers, I had gone to Indian bank to fill a form and I paid for 40 or 80 rupees with the letter that had handed me the State document writer R.Sachitanandam. A civil servant had to passes at home the following week to see our land. In fact he came never !

11 - To the same time, the panchayat, then S.Sudhakar asks us for 15 lacks rupees. They racketted us in fact. We refused evidently. They are going to go as far as installing two streamers at on which it was written that we didn't have the right to sell our land without the agreement of the panchayat. I immediately pulled these streamers.

The panchayat, the brother of the villain V. Mani threatened to kill me about thirty witnesses while specifying that we can call the police and that she won't come because the panchayat bought the police. And in fact, we will phone the police and it won't move, the corruption of the police of Kottakuppam is established, one has the absolute proof of it.

12 - Provided of these two streamers, the day even I go to the Dasildar in Vanur, and there on what I fall, on a meeting where was present the Dasildar, the chief of the Taluk office of Kottakuppam, his employee and the sub-inspector named Govindan that had told me at the time of a meeting that he would help me.

When I showed them these streamers, together they answered to me that they could not make anything for us, that one had to go to the court, brief, they were all accomplices. Besides, I wonder if their meeting didn't have for theme our problem. All corrupted, the proof is there.

13 - In a democracy or a State of right, this problem would be settled in less than one hour.

The police station is situated to 200 meters of the Taluk office of Kottakuppam, it was sufficient that the police listens attentively to my complaint, that a policeman examines my documents, it takes 5 minutes, that he accompanies me like witness in the Taluk office, that I renew before him my demand in the Taluk office and that in case of refusal he asks him to satisfy on the field my demand.

14 - From that moment, of two things one, either the pata exists for the totality of our land and the problem is settled, either the pata only exists for a part of our land or don't exist at all, and in that case, the police must record my complaint against the panchayat for swindle.

15 - To finish, whatever is the situation, we are able to prove that we live here since close to 10 years, according to the legislation in force, we will be able to require the pata at the end of the twelfth year, therefore we would not understand why the Dasildar or the collector of Villupuram would not give it to us from now on to finish this case, because we don't drop ever.

16 - It is necessary to understand that we are facing swindlers who are not any to their first first attempt as I wrote it in one of my letters, they already swindled several people, of the preference foreigners, while proceeding precisely in the same way.

17- Nine months later, by the slant of the consular attaché in station in Chennai that retires us in relation with a former Collector of Villupuram, we learn that we are in possession of no legal document and that our only recourse is to lodge a complaint for swindle to the Hight-court of Chennai against our village to get a pata for a part of our land, while it will be forever impossible for the other part that was sujette to the protective law of the coastal and forbidden to the sale and to the construction.

Il nous remet un document qui en réalité n'a aucune valeur légale, mais nous l'ignorions évidemment. Nous demandons si tout est en ordre, ils nous répondent que oui avec le sourire. Ce terrain m'avait été proposé par un de mes élèves de l'Alliance française, S. Sudhakar qui habitait dans ce village.

2- Quelques temps plus tard, nous recevons la visite du Talaivar (chef de district) de Kottakuppam, M. Chanmugan, qui nous propose de nous aider pour avoir l'électricité. Nous lui versons 25.000 roupies car nous avons demandé 3 phases et il va falloir installer un poteau supplémentaire.

3- Une semaine plus tard nous avions le courant électrique. Ce que nous ignorions, c'est que le fonctionnaire du Taluk office of Kottakkuppam était venu avec lui ou son fils mesurer notre terrain en notre absence. Du coup, nous n'avons pas eu accès au cadastre (land-registry book) où figure notre terrain et nous n'avons pas pu voir qu'il y avait un problème avec le pata ou qu'il n'existait pas. Ainsi on a la preuve absolue de la connivence entre les voyoux de ce village qui nous ont vendu ce terrain, en fait V. Mani leur chef, et M. Chanmugan qui nous a trompé sciemment.

4- En 2004, à la suite de multiples problèmes avec ces voyoux, nous décidons d'enregistrer officiellement notre terrain à Vanur. Là, nous présentons le document du panchayat et celui du Taluk office de Kottakuppam, pas de problème. Le document du panchayat ayant été établi en faveur de mon épouse, c'est elle qui me le vend compte tenu de son mauvais état de santé. Nous étions accompagnés par S.Sudhakar qui connaissait le responsable de ce bureau et qui servait de témoin d'une certaine manière.

5- En 2006, mon épouse subissait en France une très grosse opération cardiaque, la pose de deux valves à l'intérieur du coeur, sinon il lui restait 6 mois à vivre selon les médecins.

6- En 2009, l'état de santé de mon épouse demeurant inquiétant, nous décidons de vendre notre terrain le plus vite possible, car elle ne peut plus vivre en Inde et ne supporte plus la chaleur depuis son opération.

7- Deux personnes se présentent par hasard au mois de mars pour acheter notre terrain. Nous tombons d'accord sur le prix, la vente peut avoir lieu immédiatement, mais problème, elles nous réclament le pata que nous n'avons pas.

8- J'en parle avec S. Sudhakar, et là de nouveaux problèmes vont survenir.

9- Je suis allé au Taluk office de Kottakuppam. La première fois le fonctionnaire m'a dit qu'il me fournirait le pata sous 10 ou 15 jours, et la fois suivante le pata n'existait plus. Il faut dire qu'un employé qui travaille dans ce bureau et qui habite dans notre village, avait entendu notre conversation, il a dû en parler avec V. Mani qui a ensuite fait pression sur ce fonctionnaire, cela s'appelle aussi de la corruption de fonctionnaire.

10- Juste avant j'étais allé rencontrer le Dasildar (sous-préfet) à Vanur, je lui avais expliqué notre problème, il m'avait indiqué la démarche à suivre pour obtenir le pata, j'étais donc passé par différents bureaux, j'avais rempli des papiers, j'étais allé à Indian bank pour remplir un formulaire et j'ai payé 40 ou 80 roupies avec la lettre que m'avait remis un autre fonctionnaire du bureau de Vanur. Un fonctionnaire devait passé chez nous la semaine suivante pour voir notre terrain, en fait il n'est jamais venu !

11- Au même moment, le panchayat, puis S.Sudhakar nous réclame 15 lacks roupies, ils nous rackettent. Nous refusons évidemment. Ils vont aller jusqu'à installer deux banderoles devant chez sur lesquelles il était écrit qu'on n'avait pas le droit de vendre notre terrain sans l'accord du panchayat. J'arrachais aussitôt ces banderoles.

Le panchayat, le frère du voyou V. Mani me menace alors de mort devant une trentaine de témoins en précisant que nous pouvons appeler la police et qu'elle ne viendra pas parce que le panchayat a acheté la police, et effectivement, nous téléphonerons à la police et elle ne se déplacera pas, la corruption de la police de Kottakuppam est établie, on en a la preuve absolue.

12- Muni de ces deux banderoles, le jour même je me rends chez le Dasildar à Vanur, et là sur quoi je tombe, sur une réunion où étaient présents le Dasildar, le responsable du Taluk office de Kottakuppam, son employé et le sub-inspector Govindan qui m'avait dit lors d'une rencontre qu'il m'aiderait. Quand j'ai sorti ces banderoles, tous en coeur m'ont répondu qu'ils ne pouvaient rien faire pour nous, qu'on devait aller au tribunal, bref, ils étaient tous complices, d'ailleurs je me demande si leur réunion n'avait pas pour thème notre problème. Tous corrompus, la preuve est là.

13- Dans une démocratie ou un Etat de droit, ce problème serait réglé en moins d'une heure. Le commissariat de police est situé à 200 mètres du bureau du Taluk de Kottakkupam, il suffisait que la police écoute attentivement ma plainte, qu'un policier examine mes documents, cela prend 5 minutes, qu'il m'accompagne comme témoin au Taluk office de Kottakkupam, que je renouvelle devant lui ma demande à ce fonctionnaire et qu'en cas de refus il lui demande de satisfaire sur le champ ma demande.

14- A partir de ce moment-là, de deux choses l'une, soit le pata existe pour la totalité de notre terrain et le problème est réglé, soit le pata n'existe que pour une partie de notre terrain ou n'existe pas du tout, et dans ce cas-là, il doit enregistrer ma plainte contre le panchayat pour escroquerie.

15- Pour terminer, quelle que soit la situation, nous sommes en mesure de prouver que nous habitons ici depuis près de 10 ans, selon la législation en vigueur, nous serons en mesure d'exiger le pata au bout de la douzième année, donc nous ne comprendrions pas pourquoi le Dasildar ou le collector (préfet) de Villupuram ne nous le donnerait pas dès maintenant pour terminer cette affaire, car nous ne laissons jamais tomber. J'apprendrai plus tard que même au bout de douze,le gouvernement ne délivre de pata que pour une petite parcelle de terrain et non pour des terrains de la taille du nôtre.

16- Il faut bien comprendre que nous sommes face à des escrocs qui n'en sont pas à leur premier coup d'essai comme je l'ai écrit dans une de mes lettres, ils ont déjà escroqué plusieurs personnes, des étrangers de préférence, en procédant exactement de la même manière.

17- Neuf mois plus tard, par le biais de l'attaché consulaire en poste à Chennai qui nous met en relation avec un ancien préfet de Villupuram à la retraite, nous apprenons que nous sommes en possession d'aucun document légal et que notre seul recours est de porter plainte pour escroquerie au Hight-court de Chennai contre notre village pour obtenir un pata pour une partie de notre terrain, tandis que ce sera à jamais impossible pour l'autre partie qui était sujette à la loi de protection du littoral et interdit à la vente et à la construction.
